Thomas J. Ashenden named 2018 Georgia Super Lawyer

Personal injury attorney Thomas J. Ashenden has been named one of the top attorneys in Georgia by the prestigious Super Lawyers selection committee. The 2018 selection marks Ashenden’s fifth consecutive year on the list, which represents the top 5% of lawyers in the state.

Verdict leads to settlement for driver hit by fire truck.

A verdict in Clayton County leads to significant settlement for the driver of hazardous material tanker truck hit by a fire truck.

Attorney Thomas J. Ashenden of Ashenden & Associates with co-counsel Gary Cooper recently completed a jury trial in Clayton County, Georgia for client Ron B., a tanker truck driver.

The Wreck

As Mr. B. was driving down a busy highway in Clayton County when a fire truck approached his tanker truck from behind. The county fire engine had emergency lights and sirens activated according to reports, but Mr. B. did not hear or see anything as he proceeded through a left-hand turn. The fire engine proceeded through the intersection in an oncoming lane and collided with Mr. B.’s hazardous materials tanker truck.

The crash resulted in horrific and life-threatening injuries.

The Trial

At trial, county lawyers argued Mr. B. should have heard the emergency sirens had he not been wearing a Bluetooth headset. However, under Georgia law and Clayton County’s ordinances to exercise “due care,” we argued first responders have an obligation to make sure it’s safe before proceeding through an intersection.

Before trial, the judge ordered the case to be bifurcated, meaning the jury could only hear evidence as to the parties negligence and not damages in the first phase. The jury’s instructions were  to assign percentages of fault to Clayton County and our client.

The Verdict

“We are delighted that the jury found the county 100 percent negligent and our client, Mr. B., zero percent negligent,” Ashenden said.

The case went to mediation and settled for a confidential amount.

A trip to remember: Tom’s visit to Chile

Just returned from an incredible adventure to Chile with my bride, Beverly.

A trip I will surely never forget; I wanted to share some of the amazing sights we discovered during our 11 day journey. Let’s start with in the air.

This picture was taken out the window during a helicopter ride Beverly and I took. Certainly it was thrilling to get so close to the snow covered mountains at that altitude while also taking in the incredible beauty. 

Beverly and I will always treasure the moments we spent together and with our friends from Highlands, North Carolina and Atlanta. Taking in the vastness and majesty of the country’s mountains, it’s natural lakes, and the sea, are fond memories we’ll never forget.

And the weather was practically perfect! Sunshine and blue skies held out for 10 of our 11 days.

Music is a passion of mine, and this happy picture really says it all. Beverly snapped one of me sitting-in with a Chilean guitarist: a man who can play at a level I could only hope to achieve.

Closing-out our trip in Chile’s capital, Santiago. A bustling modern city with rich history and architecture. We found the perfect spot to enjoy some local wine, delicious cuisine, and time with friends.

Cold weather tips for the road

The new year is off to a freezing start across the Southeast, so now is the best time to make sure you  and your vehicle are ready for the cold.

ICE ON THE ROADS? Don’t panic!

We saw a lot of ice and snow cripple South Georgia just a few days into 2018. Auto club AAA advises drivers to accelerate and decelerate slowly: failure to do either could cause you to lose control. Give extra distance to other drivers, and try to maintain a constant speed up and down hills.

If you get into an accident, here are some tips.

DID YOU KNOW? Tire pressure drops 1 psi for every 10 degrees colder outside.

Research from a leading tire manufacturer shows that changing temperatures can have a direct impact on pressure. Inflate your tires to the proper pressure. Too much or too little air could impact how your vehicle handles on the road. This is true once it warms-up too, so keep an eye on the weather and your wheels.

WHAT TO PACK? Safety experts say keep an emergency kit in your vehicle at all times.

Ready.Georgia suggests drivers pack some essential items in their vehicle in the event they get stuck — whether in a cold setting or not. Items like a flashlight, extra batteries, jumper cables, a First Aid kit, blanket, bottles of water and energy bars just to name a few. These items last for a long time and come in handy if you suffer vehicle trouble. Kits are available for purchase at retailers in Metro Atlanta or online.

Ashenden & Associates recovers $225,000 for slip and fall victim

Ashenden & Associates recovers $250,000 for slip and fall victim.

A Fairburn restaurant must pay nearly a quarter of a  million dollars after a slip and fall case that happened on a greasy floor nearly three years ago.

The victim, a metro Atlanta woman identified by initials K.E. She suffered injuries to her knee and rotator cuff when she slipped in October 2014 at a Fairburn restaurant. Witnesses testified there were no warning signs and that the grease on the floor was hard to see.

“You could tell there was some type of substance on the floor like grease from the chicken that they were frying in the kitchen,” a witness testified.

Ashenden & Associates represented K.E. in her case against the restaurant. Attorney Tom Ashenden sought a fair settlement to cover extensive medical costs for K.E.’s multiple surgeries as well as lost wages, and suffering.

Ashenden and K.E. walked away from the wing company’s top offer of $65,000 before arbitration.

The decision paid-off just weeks before Christmas when a $225,000 recovery was announced.

“We are delighted with the results for K.E.,” Ashenden said, “We are committed to getting our clients what they deserve, and her patience paid-off in this situation.”
